What qualifies as a personal injury claim in New South Wales?
A personal injury claim may apply when someone suffers harm—physically or psychologically—due to another person’s actions or negligence. This includes car accidents, slips and falls, workplace injuries, medical errors, or even exposure to unsafe conditions in public or private settings. To lodge a claim, the injured person must usually show that the other party owed them a duty of care and that the injury caused significant loss, such as income reduction, medical expenses, or ongoing care needs. In New South Wales, strict time limits apply, so early legal advice is recommended.
How long do I have to make a personal injury claim in NSW?
In NSW you have 3 years from when the cause of action is “discoverable”. This is not suspended till minors turn 18. There is plenty of case law on what discoverable means so you should speak to a lawyer as soon as possible. The safest way to look at is you have three years from the incident/injury date but if you are outside this period you should get advise due to the use of the word “discoverable”. Qld is different, as are the time limits in car accidents and workers compensation claims.
